TERMS AND CONDITIONS FOR BANFFSHIRE HOLIDAY COTTAGES

Property to be let: Gowanbank, Queen Street, Huntly, Aberdeenshire, AB54 8EB DEPOSIT TERMS. For bookings 2 calendar months or less before the arrival date you must pay the total price on booking. For bookings more than 2 calendar months before the arrival date we will confirm bookings on receipt of a deposit for 25% of the total balance. Payment in full is to be made 2 months prior to arrival by Paypal, direct bank transfer or cheque made payable to Laura Riley as above.

GENERAL TERMS. Guests are asked not to arrive before 4pm to allow for additional cleaning and maintenance. On departure guests should vacate the house by 10am. We do expect our guests to leave the house in a clean and orderly condition!Electricity and linen (including towels) are included in the price. A cot is available upon request. The house is non smoking throughout. We accept payment by cheque, direct bank transfer or Paypal which allows payment by most credit or debit cards. We reserve the right to offer late deals on unsold breaks at reduced prices. Bed linen and towels are provided for use in the house only. We reserve the right to make a charge for missing items or damages and for any other costs which we incur apart from the cost of normal cleaning. The person who makes the reservation agrees to take responsibility for the party occupying the property. If arriving guests have to be relocated in alternative accommodation due to late departure or damage the tenant will be liable for additional costs incurred. The owners have no control over other businesses in the area and will not be responsible for any facilities which are unavailable. The Hirer warrants that the property let is to used for the purposes of a holiday and so accepts that the letting is a holiday let to which (Section 12 (2) and paragraph 8 of Schedule 4 of the Housing (Scotland) Act 1988 applies, namely, "a tenancy the purpose of which is to confer on the tenant the right to occupy the house for a holiday") It is the tenants responsibility to be at the house on the due date and any delay or inaccessibility incurred due to detrimental travel or weather conditions is not the responsibility of the owners. Guests should be aware that it gets cold in winter in Scotland. Once we have accepted a booking we will make every effort not to make any changes or cancel it. However, in certain circumstances we reserve the right to do so. Please be aware that cellphone signals are weak in the area. Any complaints must first be referred to the owner/caretaker during the tenancy to allow remedial action to be taken. In no circumstances can compensation be made for complaints raised only after the tenancy has ended should the tenant fail to advise the owner/caretaker during his/her tenancy. The owners do not warrant that all equipment including the central heating system, water and electricity system will operate throughout the tenancy. Should the central heating system, water or electricity system fail the owner will take all reasonable steps to rectify the fault. The owner or trades person must be permitted access to the property to rectify the fault. Tenants should be aware that should there be a failure on a weekend, it may not be possible to provide a trades person until Monday. The owners may at their discretion offer compensation but this is not guaranteed. The owners accepts no liability for any act, neglect or default on their part or any other person not employed by them or under their control, nor for any accident, damage, loss, injury, expense or inconvenience to either person or property which the tenants, or any other person, may suffer or incur arising from, or in any way connected with, the tenancy. The owners accept no liability for loss or damage to the tenants possessions on the owners land or property. If tenants breach any of the above terms and conditions the owners or their representatives reserve the right to re-enter the property and terminate the tenancy, without prejudice to the other rights and remedies of the owners. If any term or provision in these booking conditions shall in whole or in part be held to any extent to be illegal or unenforceable under any enactment or rule of law, that term or provisions or part shall, to that extent, be deemed not to form part of this agreement and the enforceability of the remainder of this agreement shall not be affected. All prices in our website are in pounds sterling. We do everything we can to ensure the accuracy of the information contained in our website, however, all information is accepted in good faith, and may have changed by the time you view it. CANCELLATION POLICY Cancellations made more than 2 calendar months before arrival date = Loss of deposit, 4-8 weeks before arrival date = 50% charge, less than 4 weeks before arrival = 100% charge. We reserve the right to cancel a booking if the deposit is not paid within 5 days of making the booking. We also will cancel the booking if the outstanding balance is not received 2 calendar months before the date of arrival. In this instance the deposit paid shall be nonrefundable. If we are able to resell the booking all monies will be refunded less a deduction for any costs incurred by ourselves (e.g. for re-advertising). Guests are recommended to obtain travel insurance to cover delayed arrival or cancellation.

LIMITATION OF LIABILITY Under all circumstances the owners liability will be limited to the sum received from the tenant.
